Entertainment services, the celebration zone according to the list on the Operator’s website at the permanent address https://www.lasertag.in.ua/.

If you accept the Services offered in the Family Entertainment Complex “Lazertag G-75”, it is considered that you fully and unconditionally agree with all the terms of the following Public Offer (agreement) for the provision of services, in full and unconditionally accept it (including agree to fulfill yci the obligations imposed on you by the Agreement (public offer) on the provision of services and you understand all its provisions).

Terms and definitions:

Entertainment center – (hereinafter referred to as the “Center”, or “RC”) the entertainment center “LAZERTAG G-75” which includes Game Zones, as well as Celebration Zones. Entertainment centers “LASERTAG G-75” is not a catering organization. Detailed information about the entertainment centers “LAZERTAG G-75” is available on the official website – https://www.lasertag.in.ua/;

Client – (“User” or “Users”, or “Consumer” or “Consumers”) any natural person who wishes to use and / or uses the services of the RC / who pays for goods and / or services provided in the RC, including, but not limited to: payment for services, payment for the cost of the organization of the Holiday, payment for goods;

Infant – A minor, incapacitated individual whose age at the time of visiting the RC is up to 1 year inclusive;

Child or Children -One or more minors, incapacitated individuals whose age at the time of visiting the RC is from 1 to 18 years inclusive;

Adult or Adults – One or more adult capable individuals, as well as, in cases established by law, adult capable individuals;

Accompanying – An adult who is a legal representative authorized by law or on other legal grounds to be responsible for the Infant, Child and / or Children whom he accompanies when visiting the RC;

Services – RC activities related to the organization of entertainment activities on the territory of the RC, pre-booking and access to the Celebration Zone.

Operator – There is an individual entrepreneur (FOP), the list of which is given in the Section “Detals” or in Appendix №1 to the Agreement, who actually provides a service/sells goods in the appropriate Location, The details of a specific operator are indicated in the settlement document (fiscal check) issued to the client at such a location.

And also authorized persons, employees or employee of the RC and / or employees or employee of third parties who provide services and / or sell goods in the RC on the basis of relevant contracts, empowered to make decisions by virtue of their labor duties, including, but limited to: RC managers, administrators, instructors, animators, Administration;

Play area– The territory of the RC, which is intended for active games, on which game elements are located.

Game elements -Parts of the RC intended for use by Guests as game activities in accordance with these Rules.

Equipment – laser tag gaming equipment, including blasters, sensors, quest props, electronic devices, scenery, and other elements used during the game.

Holiday (or Event) – a mass event for a limited number of people, such as: celebration of birthdays and graduations, held in a specially allocated room during the time period established in the order with the provision of a set of RC services;

The celebration zone is a separate room on the territory of the RC for the celebration.

Registration form – a special registration form containing personal data of Clients, namely:

Full name of the Client or child, contact phone number, e-mail address, date of birth.

Location Reception – a part of the RC territory where payment for services and/or goods provided, consultation on the Services is carried out.

Location is a separate entertainment space (game zone, hall, playground), at the address of which the Operator carries out economic activities. The list of all Locations and a specific FOP (Operator) is given in paragraph 8

Annex №1 to the Agreement (Public Offer).

Payment for booking (advance payment) – the amount of money paid by the Client to the Operator in order to reserve (fix) for the Client a specific date, time and Location for the Event (Holiday). This payment is a confirmation of the seriousness of the Client’s intentions and a means of ensuring the fulfillment of obligations. Payment for the reservation is included in the total cost of the Services and is subject to crediting at the final settlement on the day of the event.

The Maze is a specially equipped play area of the Entertainment Center, which is a system of partitions, passages, decorations and structural elements designed for active games, including laser tag and some types of quest, which can be in a darkened state, with limited visibility, special light and sound effects. Staying in the Labyrinth involves the active movement of visitors, the possibility of collisions with structural elements and other participants in the game, which is associated with an increased risk of minor injuries.

1. General provisions.

1.1. This Public Offer defines the terms of the Agreement in accordance with Art. 641 of the Civil Code of Ukraine and is an official public offer of business entities specified in the Details section in Appendix №1 to the Agreement, at the address at which the event takes place, respectively (hereinafter referred to as the Operator), addressed to those individuals who temporarily or permanently reside or stay on the territory of Ukraine (hereinafter referred to as the “User” or “Users”, or “Consumers”, or “Consumers”), to conclude an Agreement on the provision of entertainment services to the User, access to the celebration area and other Additional services on the terms set out below.

1.2. In the future, according to the text of the Public Offer (Agreement), the Operator and the User are collectively referred to as the “Parties”, and each separately as the “Party”. 1.3. Each Party shall guarantee to the other Party that it has the necessary legal capacity, as well as all the rights and powers necessary and sufficient for the conclusion and performance of the Agreement in accordance with its terms.

1.4. The text of the Public Offer (Agreement) and its Annexes, which are an integral part, are always posted on the information stand and in the Consumer’s Corner at the entrance to the RC, as well as on the official website of the Operator https://www.lasertag.in.ua/ and is necessarily offered to the User for review until he accepts (accepts) the Public Offer.

2. Offer (public offer)/ Subject of the contract.

2.1. The subject of the Public Offer/Agreement (hereinafter referred to as the Public Offer and/or Agreement) is the provision by the Operator to the User for a fee of RC services, namely:

– Entertainment services – which include active games on playgrounds, entertainment quests in the quest area, the attraction “Laser Labyrinth”, the attraction “Puzzles”, the attraction “Neotrack”, the attraction “Lasertag”, general animation and other services on the terms specified by the Agreement in accordance with the list on the Operator’s website at the permanent address https://www.lasertag.in.ua/

– Celebration area – separate premises on the territory of the RC for the celebration;

2.2. The contract is considered concluded and becomes effective as an accession agreement from the moment the Client takes the actions provided for in p. 3.4 of the Agreement, which means full and unconditional acceptance by the latter of all the terms of the Agreement without any exceptions and/or restrictions in accordance with Article 642 of the Civil Code of Ukraine.

2.3. The contract for the provision of services in the RC concluded by the User through the acceptance of the Public Offer, has legal force in accordance with Article 642 of the Civil Code of Ukraine and is equivalent to the contract signed by the parties and is considered to be the one with which the User has read and agrees with the terms of this Public Offer (agreement).

2.4. This Agreement is valid for the entire period of the Client’s stay in the RC, or until the moment of termination on the grounds determined by the terms of the Agreement and/or the norms of the current legislation of Ukraine, but in any case until the Parties fully fulfill their obligations under the Agreement.

3. The procedure for concluding the Agreement.

3.1. The contract is concluded between the Operator and the User in the form of an accession agreement (Art. 634 of the Civil Code of Ukraine).

3.2. Acceptance (acceptance) of the Public Offer is the performance by the User of any of the actions specified in p. 3.4 of the Agreement.

3.3. Acceptance (acceptance) of the Public Offer means full, unconditional and unconditional acceptance by the User of all the terms of the Agreement without any exceptions and/or restrictions and is equated in accordance with Part 2 of Art. 642 of the Civil Code of Ukraine before the conclusion of a bilateral written Agreement by the Parties on the terms set out in this Public Offer and its Annexes. The conclusion of the Agreement means that the User:

• Fully familiarized himself with the rules of operation of the RC, Tariffs https://www.lasertag.in.ua/, as well as the Rules of Conduct in the Family Entertainment Complex “LAZERTAG G-75” for Users (Appendix №.1);
  
• Recognizes the unconditional suitability of attractions, equipment, other services, additional services of the RC and the Rules of Conduct in the Family and Entertainment Complex “LAZERTAG G-75” for Users (Appendix №1) for the actions described in this Agreement;
  
• Accepts all the terms of this Agreement and its Annexes without comments and objections;
  
• Consents to the processing and storage of his personal data in accordance with the provisions of the Law of Ukraine “On Protection of Personal Data” and recognizes ïx as obtained from open sources;
  
• Allows shooting it on photo and/or videotape, processing of such photos, other artistic works, public, display, reproduction and distribution of ïx, in order to disseminate information about the activities of the RC, within the framework of the Operator’s commercial activities in the field of providing services, in compliance with the requirements of the current legislation of Ukraine.

3.4. In accordance with Article 642 of the Civil Code of Ukraine, the User confirms the fact of acceptance (acceptance) of the Public Offer after familiarization with the conditions set out on the information stand and in the Consumer’s Corner at the entrance to the Family Entertainment Complex “LAZERTAG G-75”, as well as on the official website of the Operator https://www.lasertag.in.ua/ by performing any of the following:

• Leaving the Advance Payment (Advance Payment) for the booked Holiday;
• Payment for services provided by the Operator in accordance with section 4 of the Public Offer;
• Payment of the “LAZERTAG G-75” gift certificate for ordering entertainment services and other additional RC services;
• Direct use by the User of the Operator’s services, the Celebration Area, receipt of other additional services, payment of the “LASERTAG G-75” gift certificate for ordering entertainment services and other Additional RC services; filling in the feedback forms on the operator’s website;
• Applying for advice on the Operator’s services by phone/oral, messengers or on the Operator’s social networks;
• Making a pre-booking.

3.5. The term of acceptance of this Public Offer is unlimited.

3.6. At the time of acceptance of the Public Offer, the User chooses the method of payment for the Services and pays for the service in full before the start of the provision of the Services, which gives the right to enter and use the services of the RC.

3.7. Each User undertakes to comply with the terms of the Agreement and its Annexes, as well as to maintain cleanliness and order throughout the territory of the RC.

3.8. The User has the right to refuse to provide the Services within 10 (ten) minutes from the moment of the start of the entertainment program in the RC with a refund of the funds paid for the Services, subject to the presentation of identity documents (passport, certificate of registration number of the taxpayer’s registration card according to the State Register of Individuals – Taxpayers) and a cash receipt. If you are on the territory of the RC for more than 10 (ten) minutes after the start of the entertainment program, the funds for the purchased Services are not refundable.

4. The order of settlement.

RC services (incl. Entertainment services, celebration zones and additional services) are provided to the User on a paid basis in accordance with the terms of the Agreement and the Tariffs, which are indicated on the information stand and/or on the official website of the Operator https://www.lasertag.in.ua (hereinafter referred to as “Tariffs”). The User understands and agrees that the Tariffs/Prices for RC and ïx list services are determined and changed solely by the decision of the Operator and/or the Counterparty. Familiarization with these Tariffs takes place through the information stands of the RC and the Operator’s website https://www.lasertag.in.ua.

4.1. The right to visit the RC is granted after the Consumer chooses the method of payment for the Services, chooses the location where the Service will be provided and leaves the Advance Payment (advance) for the Holiday.

4.2 Services are provided on the basis of prepayment (advance payment). In the absence of an advance payment, the RC does not guarantee the possibility of receiving the RC Services by the Consumer, within the specified period and volume.

4.2. By choosing the method of payment for the Services and the Location, the User acquires the right to use the Entertainment Services, the Celebration Zone and Additional RC services, which are paid separately, on the terms and in the amounts established by the Operator in the Agreement and its annexes.

4.3. Users can additionally familiarize themselves with the full list of services that Users can use on the territory of the RC, as well as the procedure and rules for using these services and ïx payment, at the information stands and from the administrators of the RC.

4.4. Additional services can be purchased by the Consumer during the period of visiting the RC for an additional fee in accordance with the tariffs of the Operator and/or the Counterparty providing such services on the territory of the RC on the basis of contracts with the Operator.

4.5. Additional services are provided on the terms specified on the Operator’s website at the permanent address https://www.lasertag.in.ua and in accordance with the price lists of the Operator and/or the Counterparty providing such services on the territory of the RC on the basis of contracts with the Operator.

4.6. If the User uses the paid time of stay not in full, the Operator does not make a monetary refund.

4.7. In the event of unforeseen technical malfunctions of the RC equipment and the impossibility of its use, the Administration of the RC “LAZERTAG G-75” reserves the right to restrict the Guests’ access to the faulty equipment, while the RC “LASERTAG G-75” is considered to have fulfilled all its obligations in full. The administration may offer the use of other Game elements, or offer a discount, in proportion to the cost of paid services, for limited Game elements.

4.8. Payment for the Services provided is made at the cash desk of the RC. The final settlement for the Event (Holiday) is made by the Client immediately before the start of the visit until the moment of provision of services (admission of guests to the Location) The amount of the final settlement is determined as the difference between the full cost and the previously paid Payment for the reservation (advance payment).

4.9. Payment for the reservation (advance payment) is paid by the Client in the amount of 1000 UAH or 15-20% of the selected entertainment, to reserve the date, time and Location.

4.10. Conditions for returning the advance.

4.10.1. In case of resignation from the Event at the initiative of the Client no later than 10 (ten) days before the agreed date, the payment is returned to the Client in full (less the commissions of payment systems) or in cash, if such payment was left in cash.

4.10.2. In case of cancellation of the Holiday (Event) later than 10 days before the date of its start, the payment for the reservation is not refundable in cash. The Operator, as an alternative, provides the Client with the opportunity to:

• Receive a gift certificate for the amount of the advance payment with a period of up to 3 months for use;
• Or fix the credited amount on the Client’s balance sheet (Deposit), which can be used on any

Location of the Operator for 12 months. The fixed amount of the advance may be used by the Client at any location specified in Appendix №1 to this Offer.

5. The procedure for visiting the RC.

5.1. The beginning of the User’s visit to the RC is recorded by paying by the User the cost of the visit (acceptance of the offer) and/or the actual passage near the Reception Location.

5.1.1. The beginning of a visit to the RC is considered to be the beginning of the Visitor’s use of any of the Services or the premises of the RC, the Celebration Zone, the Game Room, etc.

5.2. The end of the visit to the RC is considered to be the end of the booked time of visiting the RC.

5.3. The duration of stay on the territory of the Users’ RC is limited by the amount of time for which the User made a reservation.

5.3.1. Users have the right to stay on the territory of the RC only during the hours set by the Operator, that is, during the period of the RC operation. The General Rules for Visiting the RC for Users and the procedure for using the RC Services are the essential terms of this Agreement and are defined in Appendix № 1 to the Agreement, as well as indicated on the information stand and/or on the Operator’s official website https://www.lasertag.in.ua/

5.4.. Users can get acquainted with the necessary information about the rules of using the services of the RC in the Buyer’s Corner or from the administrators and instructors of the RC who control the safety of visiting the RC.

5.4.1. Failure to comply with the Rules for visiting the RC for Users, the rules set out in this Agreement, the terms of the Promotions or an attempt to prevent other Users from performing and using the services of the RC in accordance with the terms of this Agreement, is the basis and right for the Operator to require such a User to immediately leave the territory of the RC a6o to forcibly withdraw the User from the RC, in case of his disagreement to voluntarily leave the territory of the RC (except in cases where the User has committed an administrative offense a6o criminal offense and he is detained – until the arrival of the competent law enforcement agencies). The user who caused the damage is obliged to compensate the damage caused to the Family Entertainment Complex “LAZERTAG G-75” and/or third parties, including non-received benefits and moral damage.

5.4.2. Operators are not responsible for injuries and damages received by Users as a result of their non-compliance with the Rules for visiting the RC for Users and/or the Rules for the operation of technological equipment of the RC.

5.5. The use of technological equipment of the RC takes place in accordance with the Rules of operation of such equipment.

5.6. Visiting the Center by minors.

5.6.1. When visiting the Center of a group consisting of minors, the head of the group is responsible for compliance with the terms of this Agreement, the Rules for visiting the Center and the safety rules.

If the members of the group are adults, each such member of the group is responsible for compliance with the terms of this Agreement, the Rules for visiting the Center and the rules of safety.

5.6.2. On the territory of the Center, adults are obliged to supervise children and provide them with support, explain to children the Rules for visiting the RC for Users and the Rules for the operation of equipment and to monitor children’s compliance with such rules, since adults (Accompanying) are fully responsible for children.

5.6.3. With one adult, the Center has the right to visit no more than 3 (three) children aged 1 (one) to 5 (five) years, or no more than 12 (twelve) children aged 5 (five) to 10 (ten) years, or no more than 16 (sixteen) children aged 10 (ten) to 14 (fourteen) years.

5.6.4. Children under the age of 14 (fourteen) are obliged to visit the Center only if accompanied by adults.

5.6.5. Responsibility for the safety of minor children lies with their parents or accompanying adults. The organizer does not supervise children and does not provide care services (babysitting), but only provides access to the play space. Adults are prohibited from leaving minor children on the territory of the Center without prior notice to the Administration. Notification of the Administration does not entail the transfer of responsibility for children to the Administration and is carried out for the purpose of informing the Administration about the absence of parents or adults or accompanying persons on the territory of the RC.

5.6.6. The adult accompanying the child is responsible for injuring the child in case of non-compliance with general safety standards, deliberate ignoring of the recommendations of the Operator’s staff and the established Rules. The operator and his staff are not responsible in this case.

6.1. Persons aged 18 and over independently enter and/or provide authentic personal data and other information in the registration form when registering in the RC and paying for the Services.

6.2. Information and/or data about minors under the age of 18 are entered by the Accompanying Person (one of the parents, guardians/guardians) or the Adult accompanying the child on the territory of the RC.

6.3. Representatives of the Operator have the right, in case of doubts as to the age of the person, to demand the presentation of the original photo ID issued by the competent public authority, in which the date of birth of such person or birth certificate for persons under the age of 14 is assigned.

6.4. The technological equipment of the RC within the meaning of this Agreement includes technical equipment, as well as technological equipment and structures with the help of which the RC Services are provided, including but not limited to: laser tag, shock bracelets, props for quests, etc.

6.5. Users are prohibited from using technological equipment if they have not familiarized themselves with

Rules for visiting the RC for Users and the Rules for the operation of such equipment.

6.6. The total number of Users who can simultaneously be on the territory of the Game Zone is limited and determined by the Operator at each Location individually.

6.7. When the maximum number of Users is on the territory of the RC, the Operator has the right to refuse to provide the Services.

6.8. Visitors to the RC are responsible for the consequences of their actions, their own inattention and/or negligence. List of factors, situations and events that pose a danger to visitors to the RC:

1) Drop of visitors:

– due to game moments and collisions with other players or game constructions;

– as a result of slipping and/or stumbling;

– as a result of the frivolous behavior of visitors or as a result of being in a state of intoxication (alcoholic, drug, etc.);

2) the impact of falling objects: visitors’ belongings; tools; other objects;

3) the effect of objects moving sequentially:

– violation of safe distances;

– capture and movement of limbs, hair, parts of clothing, etc.; blow;

– violation of the speed limit;

– start or stop;

4) impact on visitors due to:

– collision of visitors with elements of the structure and with each other;

– stuck body, body parts, clothing and elements of clothing of visitors;

– exceeding the magnitude and duration of accelerations, including those associated with shocks;

– actions of forces on the part of fixing devices and landing sites;

5) electrical and electromagnetic influences in the form of:

– electric shock;

– the occurrence of an electric arc;

– electromagnetic field;

6) unfavorable environmental conditions:

– seismic loads;

– thunderstorm electrical discharges;

7) danger associated with the peculiarities of evacuation of visitors under emergency circumstances:

– extreme loads on structures due to the accumulation of large masses of people; panic, crowding in the crowd;

– evacuation of visitors in the presence of narrow passages, etc.;

8) danger associated with a state of increased anxiety according to medical indicators; Risks of RC Visitors

From the influence of factors, situations and events that pose a danger to visitors regardless of the will of the Parties,

The occurrence of which they cannot predict a6o prevent the occurrence of ïx.

6. Rights and obligations of the Operator.

6.1. The operator is obliged to:

6.1.1. Place the Operating Rules next to each technological equipment, and at the User’s request, additionally conduct a short oral briefing with the User on the rules of conduct in a specific game room, the use of gaming equipment and safety rules, which excludes the dual interpretation of this Agreement and its Annexes by the User.

6.1.2. Provide the User who has read the relevant Rules or has been instructed in accordance with p.

6.1.1, the right to use such a game room and the corresponding gaming equipment.

6.1.3. In the process of receiving RC Services by Users, Operators carry out activities to supervise the Users’ compliance with the rules for the use of services and other equipment, in order to prevent possible injury, damage to health or property, as well as to provide first aid to Users in the event of unforeseen events related to injuries or damage to health.

6.2. The operator has the right to:

6 2.1. The Operator has the right not to allow the User to receive the service (services), or to stop the provision of services to persons in a state of alcohol, drug intoxication and in other cases provided for by this

Agreement, Rules or violation by the User of the provisions of this Agreement and/or Annexes to it, without explaining the reasons for refusal to provide services, if in the opinion of the representatives of the Operators, this person raises doubts about his ability to comply with the terms of this Agreement and/or Annexes to it. When being on the territory of the RC for no more than 10 minutes, the User who is refused to provide services in accordance with the conditions and in the order of p. 3.9 of this Agreement, has the right to compensation for the cost of unprovided services.

6. Representatives of the Operators are authorized to take measures (including, but not limited to, prohibiting being on the territory of the RC, calling emergency medical care, security service or police) against Users who are in a state of alcohol, drug and other intoxication, in a mentally unbalanced state, as well as against Users who do not respond to the comments of the Operator’s employees, do not comply with the terms of this Agreement and the Rules for visiting the RC.

6.2.2. The right to refuse to provide services. The speaker has the right to refuse to provide services or stop participating in the game without refund to persons who are in a state of alcohol, drug or other intoxication, behave aggressively, violate safety rules or create a danger to other visitors.

6.2.3. In case of hospitalization or loss of consciousness by the Accompanying Person of the Child, the Operators have the right to stop providing Services to such Child and take measures to notify relatives or call special services.

6.2.4. In case of gross or repeated (two or more times) violation of the terms of this Agreement and/or the Rules for visiting the RC for Users, non-responsiveness by the User to the comments of the Operators’ employees, if at the same time the User’s actions will be aimed at endangering the health, property, honor or dignity of other Users, or for the Operator’s employees, the Operator has the right to stop providing Services to such User, take measures to stop the User’s illegal actions, and offer to leave the territory of the RC.

6.2.5. If the User violates the terms of this Agreement and is forced to withdraw it from the territory of the RC, monetary compensation for unused time is not made.

6.2.6. Users who violate the terms of this Agreement may be denied the right to visit the RC next.

6.2.7. In the event that the User commits actions that are subject to signs of an administrative offense or a criminal offense, the Operator’s employees in this case have the right to act in accordance with the requirements of the current legislation of Ukraine regarding this User and call on the relevant law enforcement agencies.

The operator has the right to transfer materials to the investigative authorities for violation of Art. 173 of the Code of Administrative Offenses (including immoral behavior) and to the Guardianship and Guardianship Bodies for violations of Art. 137 and Art. 166 of the Criminal Code (including leaving minor children unattended), as well as to other authorized bodies if necessary. 6.2.5.

If the User stays on the territory of the RC beyond the working hours of the RC for Users,

The Operator has the right to stop providing Services to such a User and take measures for the User to leave the territory of the RC.

6.2.8. If the User is unable to make the final settlement for the services provided or for the losses provided to the Operator, the Operator has the right in accordance with Art. 594 – 596 of the Civil Code of Ukraine to retain the User’s property. The Operator’s right to retain the user’s property may be confirmed by the User’s debt receipt, which has the force of the transaction, regarding the confirmation of the specified debt and ensuring the fulfillment of the obligation, which is made in writing, in accordance with the requirements of Art. 547 – 548 of the Civil Code of Ukraine.

6.3. The Operator has the exclusive right to publish photo materials, broadcast video films shot in the Family Entertainment Complex “LAZERTAG G-75”.

6.4. User Delay. If the User is late for the booked time, the duration of the game does not extend. The service is considered to be provided in full according to the time of booking. In this case, the funds are not returned.

6.5. The Operator has the right to terminate the User’s participation in the game without refund in the event of:

• Violation of safety rules;
• Aggressive behavior;
• Damage to property;
• Failure to comply with staff instructions;
• Creating a danger to other visitors.

7. Rights and obligations of the User.

7.1. The user is obliged to:

7.1.1. Before using the Services, read the terms of this Agreement and its Annexes, unconditionally comply with the terms of this Agreement and the Annexes throughout the entire period of use of the services, and familiarize the content of the Agreement and the Annexes of minors accompanied by such User. Make payment for the Services in the manner provided for in Section 4 of this Agreement.

7.1.2. Before you start using the Entertainment Services, the Celebration Area and the RC equipment, carefully read the relevant Operating Rules, which are located next to such equipment, or listen to the briefing. If you have any questions about safety when using

Entertainment services, Celebration Zones and RC equipment, consult with the Operator’s employee before starting use and get comprehensive and meaningful answers to questions. It is allowed to start using the relevant Entertainment Services, the Celebration Area and the equipment of the RC only after full clarification of all controversial and/or unclear provisions of the Agreement and/or the terms of the provision of Services.

7.1.3. When using Entertainment services, the Celebration Zone and RC equipment, comply with the legal requirements of the Operator’s employees and comply with the terms of this Agreement and the Rules for visiting the RC for

Users.

7.1.4. Make a full payment for all services provided by the Operator to the User during the User’s stay on the territory of the RC.

7.1.5. Pay for the Operator’s services only in the manner provided for by the terms of this Agreement, or by agreement of the Parties in another way provided for by the current legislation of Ukraine.

7.1.6. In case of loss or damage to the property of the RC and/or third parties through the fault of the User, he is obliged to fully compensate for the material (including lost profit) and moral damage, and the User bears other responsibility provided for by the terms of this Agreement and the current legislation of Ukraine. If the User is a minor, such a duty is assigned to the person who is the Accompanying Person.

7.2. The user has the right:

7.2.1. Use all RC services in accordance with the terms of this Agreement.

7.2.2. At the slightest signs of malaise or injuries, the User has the right to contact the RC administrator for help.

7.2.3. Smoking is prohibited throughout the territory of the RC.

7.2.4. In the event of damage caused to the health and/or personal belongings of the User, he has the right to contact the Operator’s representatives to record the place, time and circumstances and register the event in a letter to the RC Location on the Reception.

7.2.5. If the User does not contact the Operator’s employees, the Operator has the right to refuse to satisfy any further claims of the User.

7.2.3. Participation in the game at your own risk. The user confirms that he voluntarily participates in active games and entertainment, is aware of the possibility of injury, bruises, scratches, falls and other damage that may occur during participation in the game. The User agrees that participation in the game is at his own risk, and has no claims to the Operator in case of injury, if they are not caused by the Operator’s fault.

8. Amendment and termination of the Agreement

8.1. The Operator has the right to make changes to the Agreement unilaterally. The new version of the contract is gaining

Effective from the moment of its publication.

8.2. When the Operator makes significant changes to the Agreement that affect the possibility of using the services of the RC

The User, the Operator notifies the User about them, by publishing ïx on the official website of the Operator.

The contract can be terminated:

8.2.1. The User unilaterally by refusing the services (services) of the Operator within 10 (ten) minutes after the start of the provision of the Services with a full refund of the cost of the paid services.

8.2.2. By the User unilaterally by refusing the services (services) of the Operator after the expiration of 10 (ten) minutes after the start of the provision of the Services without refunding the cost of the paid services.

8.2.3. The Operator unilaterally without returning the funds paid but not used by the User, in case of violation of the terms of this Agreement by the User.

8.2.4. The Operator unilaterally with the return of funds paid but not used by the User, if the Operator considers this User an undesirable person to visit the RC.

8.2.5. The Operator unilaterally without refunding the funds paid but not used by the User, in the event of the end of the operating time of the RC in accordance with the mode of operation established for the RC for the Users.

8.2.6. On other grounds provided for by this Agreement and/or the current legislation of Ukraine.

9. Dispute resolution

9.1. Bci disputes and disagreements that have arisen or may have arisen in connection with this Agreement shall be resolved through negotiations on the basis of a written application of the User with a receipt for payment of the service provided by the Operator.

9.2. After receiving a complaint from the User, the Operator is obliged to satisfy within 20 (twenty) days

Complaints and legitimate demands filed by the User or send the User a motivated refusal (answer).

9.3. In the event that the dispute that has arisen is not resolved in the claim procedure, any of the Parties has the right to apply for a resolution of the dispute to the court at the location of the Operator.

9.4. In case of violation of the terms of this Agreement by the User and as a result of unilateral termination of the contract by the Operator, the amount of payment for RC services made by the User is not refundable, except for cases expressly provided for by this Agreement.

10. Liability for breach of the Agreement.

10.1. The User bears full material and personal responsibility for violation of the terms of the Agreement and/or its Annexes in accordance with the provisions of the Agreement and the current legislation of Ukraine.

10.2. During the period of stay on the territory of the RC, the User, the Accompanying Person (one of the parents, guardians/guardians) or the Adult accompanying the child are fully responsible for the compliance of minor children with the General Rules for visiting the RC for Users and the procedure for using the RC Services.

10.2. In the event of loss or damage to the property of the RC through the fault of the User, he is obliged to fully compensate for the material and moral damage caused, and the User bears other liability provided for by the terms of this Agreement and the current legislation of Ukraine. If the User is a minor, such a duty is assigned to the person who is the Companion of this person.

10.3. The RC Operator is not responsible for damages received by the Users as a result of an accident, injury or any other damage caused by the negligence of the User and/or third parties or/and as a result of non-fulfillment or/or improper fulfillment of the conditions by the User and/or third parties of this Agreement and its Annexes.

11. Other provisions

11.1. The User guarantees that all the terms of this Agreement are clear to him and he accepts unconditionally and in full. This Agreement is concluded by the User’s acceptance of this public offer, which contains all the essential terms of the contract on the terms specified in p. 3.4. without signing by the parties and without specifying the User’s personal data.

11.2. In the case not regulated by this Agreement, the Operators and the User undertake to be guided by the norms established by the current legislation of Ukraine.

12. Circumstances of force majeure (Force majeure)

12.1. The parties are exempt from liability for full or partial non-fulfillment of obligations under this agreement, if such non-performance was the result of force majeure circumstances (force majeure circumstances) that arose after the acceptance of this agreement and which the Parties could not foresee or prevent.

12.2. Military actions. Force majeure circumstances include, in particular, but not exclusively:

• Military actions;
• Military aggression;
• Combat operations;
• Shelling;
• Missile strikes;
• Explosions;
• The threat of a missile strike;
• Introduction of martial law;
• Mobilization measures;

12.3. Air alarm. Force majeure circumstances are also considered to be:

• Announcement of an air alarm;
• The need to evacuate visitors;
• Termination of the work of the shopping center during an alarm;
• Closing the shelter or moving to it.

In such cases, the provision of the service may be suspended or postponed.

12.4. Power outage. Force majeure includes:

• Emergency power outages;
• Planned power outages;
• Lack of lighting;
• Power outages;
• Technical malfunctions of power grids.

12.5. Decisions of the shopping center or the administration of the building Force Majeure are considered to be:

• Closing of the shopping center;
• Restriction of access to the premises;
• Evacuation of the shopping center;
• Technical work in the shopping center;
• Accidents in the building
• The decision of the administration of the shopping center to terminate the work.

12.6. Emergency situations

Force majeure also includes:

• Fire;
• Flooding;
• Smoke;
• Communication accidents;
• Destruction of the premises;
• Technical accidents

12.7. The actions of state bodies are considered force majeure:

• Decisions of state authorities;
• Restrictions on work;
• Inspections with termination of activity;
• Evacuation requirements;
• Ban on holding events

12.8. In the event of force majeure, the Administration has the right to:

• Suspend the provision of services;
• Postpone the reservation to another time;
• Change the format of the game;
• Reduce the duration of the game.

At the same time, the funds are not refunded, and the reservation is postponed to another available date.

12.9.. The Administration is not responsible for:

• Interruption of the game;
  
• Reduction of game time;
  
• Postponement of the event;
  
• Cancellation of the event.
• If it happened as a result of force majeure circumstances.
  
  12.10. In the event of an interruption of the game due to force majeure, the service is considered partially provided, and the unused time may be moved to another date without a refund.
